Please read these Terms and Conditions carefully before making a purchase. By completing a purchase on this website, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not proceed with your purchase.

2. Key Definitions

In these Terms, the following words have the meanings given below:

"Content" means any Artist Episode or other digital product made available for purchase on this website.

"Artist Episode" means an individual documentary film featuring a named artist, available for individual purchase.

"Purchase" means the completed transaction by which you pay the stated price and are granted Viewing Access.

"Viewing Access" means the right to watch the Content via secure, authenticated streaming through your Account, as described in these Terms.

"Account" means the personal account you create on this website to access purchased Content.

"Platform" means the Behind the Easel website and any associated digital services operated by us.

3. What You Are Buying

3.1 A Licence, Not Ownership

When you purchase Content on Behind the Easel, you are purchasing a personal, non-exclusive, non-transferable licence to watch that Content via the Platform. You are not purchasing ownership of the Content, or any copyright, intellectual property right, or physical copy of the Content.

Think of it like a cinema ticket for a film you can watch again and again — not a copy of the film that belongs to you.

3.2 Streaming Only — No Downloads

All Content is delivered via secure streaming only. No downloadable file will be provided. You must have an internet connection and a compatible device to watch Content.

We do not support and expressly prohibit any attempt to download, capture, screen-record, or otherwise extract a copy of the Content from our streaming service.

3.3 Access to Your Account

Once your purchase is complete and your Account is active, you can watch your purchased Content by logging in to your Account on this website. Access is tied to your Account and cannot be transferred to another person.

3.4 Ongoing Access

Subject to these Terms, we intend to make purchased Content available to you on an ongoing basis through your Account. However, we cannot guarantee uninterrupted or permanent access. Please see Clause 10 for more detail.

4. Your Account

4.1 Creating an Account

To access purchased Content, you must create an Account. You must be at least 18 years old to create an Account and make a purchase. By creating an Account you confirm that you are 18 or over.

4.2 Account Security

You are responsible for keeping your Account login details confidential. You must not share your username, password, or access link with any other person.

If you become aware of any unauthorised use of your Account, you must notify us immediately at hello@behindtheeasel.com.

We reserve the right to suspend or terminate your Account if we have reason to believe that your login details have been shared or your Account is being accessed by more than one person.

4.3 One Account Per Person

Each Account is for use by one individual only. Creating multiple Accounts to access Content purchased under a single Account is not permitted.

5. Pricing and Payment

5.1 Prices

All prices displayed on the Platform are in pounds sterling (GBP) and are inclusive of VAT at the applicable rate. The price you see at checkout is the price you pay.

5.2 Payment Processing

Payments are processed securely by our third-party payment processor. We do not store your card details. By completing a purchase you agree to the payment processor's terms of service.

5.3 Purchase Confirmation

Once your payment has been successfully processed, you will receive a confirmation email and your Content will be made available in your Account. Please check your spam folder if you do not receive a confirmation email within a few minutes.

5.4 Promotional Pricing and Discount Codes

We may from time to time offer promotional pricing, discount codes, or bundle offers. These are offered at our sole discretion and may be withdrawn at any time. A discount code must be applied at the time of checkout and cannot be applied retrospectively.

5.5 Bundle Purchases

Where Content is purchased as part of a bundle or collection, each item in the bundle is governed by these Terms. The bundle price is not divisible and no refund will be given for individual items within a bundle.

6. Your Licence — What You Can and Cannot Do

6.1 What You Can Do

Your purchase grants you the right to:

• Watch the Content as many times as you wish via your Account on the Platform.
• Access the Content from any personal device registered to your Account.
• Enjoy the Content for your own personal, non-commercial, private use.

6.2 What You Cannot Do

You must not, under any circumstances:

• Share your Account login details or access link with any other person.
• Screen record, capture, download, copy or otherwise extract the Content from the Platform by any means, whether technical or otherwise.
• Upload, post, stream, broadcast, redistribute, resell, sublicense or otherwise make the Content available to any third party.
• Use the Content for any commercial purpose, including showing it to a paying audience, using it in advertising, or incorporating it into any other product or service.
• Remove, alter or obscure any copyright notice, watermark or rights management information from the Content.
• Use any automated tool, bot, scraper or technical means to access, copy or extract the Content.
• Attempt to circumvent, disable or interfere with any technical protection measure applied to the Content.

Our Content is protected by copyright law and digital rights management technology. Unauthorised copying or sharing is a serious matter and will be treated accordingly.

6.3 Consequences of Misuse

If you breach any of the restrictions in Clause 6.2, we may immediately suspend or permanently terminate your Account without refund, and we reserve the right to pursue any available legal remedy including an injunction and a claim for damages.

7. Intellectual Property

All Content on the Platform, including but not limited to the films, footage, music, graphics, titles, descriptions, artist profiles, and all other materials, is owned by or licensed to Behind the Easel and is protected by copyright, database rights and other intellectual property laws.

Nothing in these Terms transfers any intellectual property right to you. Your licence to watch the Content is personal and strictly limited to the terms set out in Clause 6.

The Behind the Easel name, logo and brand are our trade marks. You may not use them without our prior written consent.

Artwork and creative works belonging to individual artists that appear in Content remain the intellectual property of those artists. Your purchase does not grant you any right to reproduce, copy, print, sell or otherwise use an artist's work.

8. Refunds and Cancellation

8.1 Digital Content and Your Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a right to cancel a purchase within 14 days of the date of purchase (the "Cooling-Off Period").

However, by completing your purchase you expressly request that we make the Content immediately available to you in your Account, and you acknowledge that by doing so you lose your right to cancel once you have begun to access the Content.

If you have not accessed the Content within the Cooling-Off Period, you may cancel your purchase and request a full refund by contacting us at hello@behindtheeasel.com within 14 days of purchase.

8.2 Faulty or Misdescribed Content

If the Content you have purchased is materially faulty, corrupted, or significantly different from its description on the Platform, please contact us at hello@behindtheeasel.com and we will resolve the issue promptly, either by providing a corrected version or by issuing a full refund.

8.3 No Other Refunds

Except as set out in this Clause 8, all purchases are final and non-refundable. We do not offer refunds on the grounds of personal preference, change of mind, or where access has been made available and the Content has been accessed.

9. Privacy and Your Data

We take your privacy seriously. When you create an Account and make a purchase, we collect and process your personal data (including your name, email address, and payment information) in order to:

• Process your purchase and provide you with Viewing Access.
• Manage your Account.
• Send you purchase confirmations and account-related communications.
• Comply with our legal obligations.

10. Platform Availability and Changes to Content

10.1 Availability

We aim to keep the Platform and your purchased Content available at all times, but we cannot guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

10.2 Changes to Content

We reserve the right to make changes to, or withdraw, Content from the Platform where we are legally required to do so, or where continued availability would expose us to legal liability. In such circumstances we will endeavour to provide reasonable notice and, where Content is permanently withdrawn, we will offer a refund for any affected purchases made within the preceding twelve months.

10.3 Changes to the Platform

We may update, change or discontinue any aspect of the Platform at any time, including technical delivery methods, streaming providers, and website functionality. We will always endeavour to maintain the quality of your Viewing Access.

10.4 Platform Closure

In the unlikely event that Behind the Easel ceases to operate the Platform permanently, we will provide not less than thirty (30) days' written notice to all registered Account holders and will offer a pro-rata refund for recent purchases at our discretion.

11. Our Liability to You

11.1 What We Are Responsible For

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach, or if it was contemplated by both parties at the time you made your purchase.

11.2 What We Are Not Responsible For

We are not responsible for:

• Any loss or damage that is not foreseeable.
• Any business loss, loss of profit, loss of revenue, loss of data or loss of opportunity (whether or not foreseeable).
• Any loss or damage caused by your failure to comply with these Terms.
• Any loss or damage caused by third-party services, including payment processors, internet service providers, or device manufacturers.
• Interruptions to the Platform caused by circumstances outside our reasonable control.

11.3 Cap on Liability

Our total liability to you in connection with any purchase shall not exceed the price you paid for that purchase.

11.4 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under English law, including your rights under the Consumer Rights Act 2015.

These Terms are governed by and construed in accordance with the laws of England and Wales.

14.2 Disputes

If we are unable to resolve a dispute informally, you may refer it to an alternative dispute resolution (ADR) scheme or to the courts of England and Wales, which shall have exclusive jurisdiction.

We may update these Terms from time to time. The version displayed on the Platform at the time of your purchase is the version that applies to that purchase. We will notify registered Account holders of any material changes by email.

15.2 Severability

If any provision of these Terms is found by a court to be invalid or unenforceable, that provision shall be severed and the remaining Terms shall continue in full force and effect.

15.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Platform and your purchase of Content. They supersede all prior representations, agreements or understandings.

15.4 No Waiver

If we do not enforce any right or provision under these Terms, that shall not constitute a waiver of that right or provision.

15.5 Assignment
